Processing and Protection of Personal Data, Cookies
The purpose of this Personal Data Processing and Protection Policy (hereinafter referred to as the “Policy”) is to provide information on what personal data of individuals is processed during the provision of services and the sale of goods by our company, for what purposes and how long our company processes this personal data in accordance with applicable legal regulations, to whom and for what reason it may be transferred, and also to inform about the rights that individuals are entitled to in relation to the processing of their personal data. The Policy has been effective since May 25, 2018, and is issued in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter referred to as “GDPR”).
I. Basic Provisions
1. The controller of personal data according to Article 4, Point 7 of Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter referred to as the “GDPR”) is Conelia Management LLC, 71-75 Shelton Street, Covent Garden, London, United Kingdom, WC2H 9JQ, company number 14978097, contact: [email protected] as the data controller. We hereby inform you in accordance with Act No. 101/2000 Coll., on the Protection of Personal Data and on Amendments to Certain Acts, as amended (hereinafter referred to as the “Act on the Protection of Personal Data”), about the processing of your personal data and your rights.
2. The data subjects are customers, potential customers, external suppliers, natural and legal persons in business relations with the Controller, employees of the Controller, and other cooperating individuals.
3. The Controller collects the following personal data: name, surname, address, date of birth, national identification number, identification number, nationality, permanent residence address, contact address, registered office, phone number, and email address. Personal data will be processed with the consent of the data subject.
4. The Controller has not appointed a Data Protection Officer.
II. Sources and Categories of Processed Personal Data
1. The Controller processes personal data that you have provided to him and/or personal data that the Controller has obtained based on fulfilling your order.
2. The Controller processes your identification and contact information as well as data necessary for the performance of the contract.
3. Sources of personal data: publicly available data lists, and communication from data subjects.
4. The Controller processes the following categories of personal data:
• Name and surname, including academic title if applicable;
• Business name;
• Identification number (ICO), VAT number (DIC);
• Permanent residence address;
• Registered office or place of business;
• Delivery address;
• Contact email address;
• Contact phone number;
• Job position and/or company role;
• Bank account details;
• Records of behaviour on websites managed by the Controller obtained from cookies if cookies are enabled in the web browser.
III. Legal Basis and Purpose of Processing Personal Data
1. The legal basis for processing personal data is:
• Performance of the contract between you and the Controller according to Article 6, Section 1(b) of the GDPR,
• The Controller’s legitimate interest in providing direct marketing (particularly for sending commercial messages and newsletters) according to Article 6, Section 1(f) of the GDPR,
• Your consent to the processing to provide direct marketing (particularly for sending commercial messages and newsletters) according to Article 6, Section 1(a) of the GDPR in conjunction with Section 7, Paragraph 2 of Act No. 480/2004 Coll., on Certain Information Society Services, if no goods or services have been ordered.
2. The purpose of processing personal data is:
• Processing your order and exercising rights and obligations arising from the contractual relationship between you and the Controller; personal data required for successful order processing (name, address, contact information) is necessary for the conclusion and performance of the contract. Without providing personal data, the Controller cannot conclude or fulfil the contract.
• Processing cookies from websites operated by the Controller. If the data subject has cookies enabled in their web browser, the Controller processes behaviour records from cookies placed on websites operated by the Controller to ensure better operation of the Controller’s websites and for the Controller’s online advertising. In case of consent to the processing of personal data for marketing and commercial purposes, this data is processed together with other personal data for this purpose.
The Controller does not engage in automated individual decision-making within the meaning of Article 22 of the GDPR.
IV. Data Retention Period
The Controller retains personal data:
• For the period necessary to exercise rights and obligations arising from the contractual relationship between you and the Controller and to assert claims from these contractual relationships (for 10 years from the termination of the contractual relationship).
• Until consent to processing personal data for marketing purposes is revoked, for a maximum of 10 years if personal data is processed based on consent.
• Tax documents issued by the Controller are archived for a period of 10 years from the end of the tax period in which the performance occurred, in accordance with Section 35 of Act No. 235/2004 Coll., on Value Added Tax. Customer contracts are also archived for 10 years from the termination of the contract to substantiate the legal reason for issuing invoices.
After the expiration of the data retention period, the Controller will delete personal data.
V. Recipients of Personal Data (Controller’s Subcontractors)
Recipients of personal data are:
• Persons involved in the delivery of goods, execution of payments based on the contract,
• Persons providing e-shop operation services and other services related to e-shop operation.
The Controller does not intend to transfer personal data to a third country (outside the EU) or to an international organization.
VI. Your Rights
1. Under the conditions set forth in the GDPR, you have:
• The right to access your personal data according to Article 15 of the GDPR,
• The right to rectify personal data according to Article 16 of the GDPR, or to restrict processing according to Article 18 of the GDPR,
• The right to erasure of personal data according to Article 17 of the GDPR,
• The right to object to processing according to Article 21 of the GDPR, and
• The right to data portability according to Article 20 of the GDPR.
• The right to withdraw consent to processing in writing or electronically to the address or email of the Controller provided in Article III of these terms.
2. You also have the right to file a complaint with the Office for Personal Data Protection if you believe your right to personal data protection has been violated.
VII. Conditions of Personal Data Security
1. The Controller declares that it has adopted all appropriate technical and organizational measures to secure personal data.
2. The Controller has implemented technical measures to secure data storage and personal data storage in paper form.
3. The Controller declares that only persons authorized by it have access to personal data.
VIII. Final Provisions
1. By submitting an order from the online order form, you confirm that you are familiar with the conditions of personal data protection and that you fully accept them.
2. You agree to these terms by ticking the consent box via the online form. By ticking the consent box, you confirm that you are familiar with the personal data protection conditions and that you fully accept them.
3. The Controller is entitled to change these terms. The new version of the personal data protection terms will be published on its website.
